1. Acceptance of Terms
By creating an account, accessing the ProxyRise dashboard, or using any part of the ProxyRise proxy infrastructure ("Service"), you agree to be legally bound by these Terms of Service ("Terms"). If you are accepting these Terms on behalf of an organization, you represent that you have the authority to bind that entity.
If you do not agree to these Terms, you must not use the Service. We may update these Terms at any time by posting the revised version on this page. Continued use of the Service after any changes constitutes acceptance of the updated Terms. We recommend reviewing this page periodically.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account and use the Service. By registering, you represent and warrant that you meet this requirement and that all information you provide is accurate, current, and complete.
Accounts registered with false or misleading information may be suspended or terminated without notice. We reserve the right to request identity verification at any time.
3. Account Responsibility
You are responsible for maintaining the confidentiality of your API key, login credentials, and any other authentication tokens associated with your account. All activities that occur under your account are your responsibility, whether authorized by you or not.
You agree to: (a) keep your credentials secure and not share them with unauthorized third parties; (b) immediately notify us if you suspect unauthorized access to your account; (c) not sell, transfer, or sublicense your account or API key to any other person or entity without our prior written consent.
ProxyRise is not liable for any loss or damage arising from your failure to secure your account credentials.
4. Acceptable Use Policy
You agree to use the Service only for lawful purposes and in accordance with these Terms. ProxyRise is designed for legitimate use cases including but not limited to: web scraping, market research, ad verification, brand protection, SEO monitoring, price comparison, academic research, and privacy-enhancing browsing.
You must NOT use the Service for:
- Any illegal activity under applicable local, national, or international law
- Fraud, phishing, identity theft, or financial crimes
- Unauthorized access to computer systems, networks, or data
- Distribution of malware, ransomware, or other malicious software
- Spam, unsolicited bulk messaging, or email bombing
- Credential stuffing, brute-force attacks, or account takeover attempts
- Distributed denial-of-service (DDoS) attacks or network flooding
- Harassment, stalking, threats, or abuse of any individual
- Child exploitation material or trafficking of any kind
- Activities that infringe intellectual property rights
- Any activity that could damage ProxyRise infrastructure, reputation, or other users
We reserve the right to suspend or terminate accounts that violate this policy immediately, without prior notice and without refund. Serious violations may be reported to appropriate law enforcement authorities.
5. Billing, Credits & Payments
ProxyRise operates on a prepaid data credit model. Credits are purchased in advance and consumed by proxy traffic, measured in gigabytes (GB) of data transferred through our network. Credits are non-transferable between accounts.
Credit validity: Purchased credits do not expire as long as your account remains active and in good standing.
Pricing changes: We may adjust pricing for new credit purchases at any time. Existing credits already purchased remain valid at the amount credited, regardless of subsequent pricing changes.
Refund policy: All cryptocurrency transactions are final and non-reversible by nature. Refunds are issued solely at our discretion and are not guaranteed.
Payment methods: ProxyRise currently accepts cryptocurrency payments only. All transactions are processed through third-party cryptocurrency payment gateways. By completing a transaction, you agree to the terms of the respective payment provider. We may introduce additional payment methods (such as credit/debit cards) in the future.
6. Service Level & Availability
We strive to maintain high availability and reliability across our proxy infrastructure. However, the Service is provided on an "as available" basis. We do not guarantee uninterrupted, error-free, or completely secure operation at all times.
Proxy availability, geo-location accuracy, IP reputation, connection speeds, and response times may vary due to factors including: upstream provider conditions, network congestion, third-party infrastructure changes, scheduled or emergency maintenance, and force majeure events.
We are not liable for losses, damages, or costs arising from service interruptions, degraded performance, or temporary unavailability of specific proxy types or locations.
7. Intellectual Property
All ProxyRise branding, trademarks, logos, user interface designs, documentation, and platform code are the exclusive property of ProxyRise and its licensors. You may not copy, modify, distribute, reverse-engineer, or create derivative works of any part of the Service without our prior written consent.
Your data remains yours. We claim no ownership over any content transmitted through our proxy network. You grant us only the limited rights necessary to route and deliver your traffic as part of providing the Service.
8. API Usage & Rate Limits
The ProxyRise API is provided for programmatic access to your account and proxy management features. You agree to use the API responsibly and within any rate limits or usage guidelines we publish.
Excessive API calls, automated abuse of API endpoints, or attempts to circumvent rate limits may result in temporary throttling or permanent API access revocation. We reserve the right to modify API endpoints, response formats, and rate limits at any time with reasonable notice.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PROXYRISE AND ITS OPERATORS, AFFILIATES, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO: LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITIES, GOODWILL, OR ANTICIPATED SAVINGS, WHETHER ARISING FROM CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total aggregate liability arising from or related to these Terms or your use of the Service shall not exceed the total amount you have paid to ProxyRise in the twelve (12) months immediately preceding the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless ProxyRise and its operators, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your infringement of any third-party rights.
11. Termination
By us: We may suspend or terminate your account at any time, with or without cause, including for: violation of these Terms, violation of the Acceptable Use Policy, fraud, chargebacks, suspected abuse, or conduct harmful to the platform or other users. In cases of termination for cause, remaining credits may be forfeited.
By you: You may stop using the Service and request account deletion at any time by contacting our support team. Upon voluntary termination, any remaining credits are forfeited unless otherwise agreed in writing.
Effect of termination: Upon termination, your access to the dashboard and API will be revoked immediately. Provisions that by their nature should survive termination (including Limitation of Liability, Indemnification, and Governing Law) will continue to apply.
12. Modifications to Service
We reserve the right to modify, suspend, or discontinue any part of the Service (including features, pricing, proxy types, and supported locations) at any time, with or without notice. We are not liable to you or any third party for any such modification, suspension, or discontinuation.
13. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of laws principles. Any disputes arising under or in connection with these Terms shall be resolved first through good-faith negotiation between the parties.
If a dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue resolution through binding arbitration or the courts of competent jurisdiction. You agree that any legal proceedings shall be conducted on an individual basis and not as part of a class, consolidated, or representative action.
14. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
15. Entire Agreement
These Terms, together with the Privacy Policy and Disclaimer, constitute the entire agreement between you and ProxyRise regarding your use of the Service. They supersede all prior agreements, understandings, and communications, whether written or oral, relating to the subject matter of these Terms.
